Habitual Traffic Offender Penalties in Florida
Have you received a notice in the mail from the DMV that your license was going to be suspended? If you have been labeled a habitual traffic offender by the Florida Division of Motor Vehicles, your license may be suspended for 5 years. You will have 30 days from the date of the order that you receive in the mail until your license is suspended.
If you have received this notice, it is important to consult an experienced attorney immediately to discuss your rights and see what may be done about this. It may have been a simple administrative error on the part of the DMV, or it may be that you will need legal representation to contest the validity of a previous charge that has counted toward your label as a habitual traffic offender.
A "habitual traffic offender" is a person whose Florida DMV record shows, within a 5 year period:
- 3 or more convictions involving:
DUI (driving under the influence)
Vehicular manslaughter
Hit and run involving injury or death
Driving without a license or driving on a suspended license
Any felony conviction involving the use of a vehicle
- 15 convictions involving moving violations which involve the assessment of points on your record
Losing your license for 5 years could greatly affect your livelihood. You will not be able to drive to work, to school or to buy groceries. If your license is suspended, you will have to wait one year before applying to the DMV to receive a limited license (which would only be used for employment, business and school).
Don't allow the next 5 years of your life to be ruined because of a label put on your head by the DMV. As an American, you have the right to contest this label and avoid having your license suspended. By working with a defense lawyer, you can avoid these harsh penalties. Your lawyer will know exactly what is needed to defend you and can take immediate action.
