If you are arrested for driving under the influence in Florida, the arresting officer will confiscate your driver's license and you will be able to drive for 10 days with the DUI citation  acting as your license. You have 10 days from the date of your arrest to schedule a hearing with the Florida Division of Motor Vehicles (DMV). If you fail to schedule the hearing, your license will be automatically suspended on the 30th day after your arrest, regardless of whether you are actually convicted of the DUI charges you face. 

When you file for your DMV hearing, you will then be given a temporary and limited license that will last for 40 to 45 days until your case is heard. This license will only allow you to drive for employment or business purposes. At your DMV hearing, however, you will have the chance to attempt to have your driving privileges fully reinstated.
