DMV Hearings in Florida
If you are arrested for driving under the influence in Florida, the arresting officer will confiscate your driver's license and you will be able to drive for 10 days with the DUI citation acting as your license. You have 10 days from the date of your arrest to schedule a hearing with the Florida Division of Motor Vehicles (DMV). If you fail to schedule the hearing, your license will be automatically suspended on the 30th day after your arrest, regardless of whether you are actually convicted of the DUI charges you face.
When you file for your DMV hearing, you will then be given a temporary and limited license that will last for 40 to 45 days until your case is heard. This license will only allow you to drive for employment or business purposes. At your DMV hearing, however, you will have the chance to attempt to have your driving privileges fully reinstated.
DUI Defense Lawyer Offering Representation at DMV Hearings
Gainesville DUI defense lawyer Robert G. Whittel offers legal representation at DMV hearings in order to offer his clients an opportunity to have their license suspension stayed. This hearing is actually similar to a court appearance in that the evidence regarding your charges will be seen and witness testimony will be heard. By working with you from the beginning and helping you with your DMV hearing, attorney Robert Whittel can begin building a strong foundation for the defense of your case.
It is important to note at this time that your Division of Motor Vehicles hearing is only regarding the suspension of your license and is not used to determine whether you are actually guilty of DUI. That will be determined in criminal court and is a separate event. In fact, you may win your DMV hearing and then lose your case in court, meaning that your license will be suspended by the court.
In order to avoid having your license suspended, consult defense attorney Robert Whittel. He can review the facts of your case to see how he may be able to defend you at your DMV hearing and in court.
